Terms of Service

1. The service

Moonsill uses artificial intelligence to create new design ideas from photos of rooms you upload. The designs are visual inspiration. They are not architectural, engineering or safety advice, they are not to scale, and the furniture and materials shown may not exist or be available to buy. Check anything important with a qualified professional before you build or buy.

2. Who can use it

You must be at least 16 years old, or the minimum age of digital consent where you live if that is higher. You are responsible for keeping your account secure and for what happens under it.

3. Credits

• A Standard design uses 1 credit and a Pro design uses 3. The studio shows the cost and your balance before you start.
• New accounts get 3 free credits.
• If a design fails because of a problem on our side, the credits are returned automatically.
• Credits have no cash value, can’t be transferred or sold, and can only be used on Moonsill.
• Monthly plans add their credits at the start of each billing period. Credits don’t expire while your account is open, but they are lost if you delete your account.

4. Subscriptions and payments

• Prices are shown before you pay and include VAT where it applies.
• Subscriptions renew automatically each month at the then-current price until you cancel. We will tell you in advance about any price change, and you can cancel before it applies.
• You can cancel at any time. On the web, cancel from your account page; in the iPhone app, cancel in your Apple ID settings. Cancelling stops future renewals; you keep your plan until the end of the period you’ve paid for.
• Payments on the web are processed by Stripe. Purchases in the iPhone app are made through Apple and are also covered by Apple’s terms.

5. Refunds and your right to cancel

If you live in the EU, the UK or another country with similar laws, you normally have 14 days to cancel a purchase of digital content. Because credits are delivered straight away, we ask you at checkout to agree that we start immediately. By agreeing, you lose the right to cancel for any credits you have used. You can still cancel within 14 days and get a refund for a purchase whose credits you haven’t used at all.

Beyond that, if something went wrong, email support@moonsill.com and we will make it right. Refunds for purchases made through Apple are handled by Apple at reportaproblem.apple.com.

6. Your photos and designs

• You keep all rights to the photos you upload. You give us permission to store and process them only to provide Moonsill to you.
• You may use the designs we create for you for any lawful purpose, including commercially if your plan allows it. We don’t claim ownership of them. AI-generated images may not be protected by copyright in some countries, and similar designs may be created for other people.
• Only upload photos you took or have the right to use.

7. Acceptable use

Don’t use Moonsill to:

• upload anything illegal, sexual, violent, hateful, or photos of people without their permission;
• infringe anyone else’s rights, including copyright and privacy;
• mislead people, for example by presenting a design as a real property to rent or sell without saying it has been virtually changed;
• overload, hack, scrape or reverse-engineer the service, or get around credit or usage limits;
• resell the service or build a competing product with it.

We may remove content or suspend accounts that break these rules. If we suspend a paid account for no fault of yours, we will refund the unused part.

8. Availability and changes

We work hard to keep Moonsill running but can’t promise it will always be available or error-free. We may change or improve features. If we make a change that significantly reduces what you paid for, we will tell you and you can cancel with a refund of the unused part.

9. Ending the agreement

You can stop using Moonsill and delete your account at any time from your account page. We may end or suspend your access if you seriously or repeatedly break these terms.

10. Liability

Moonsill is provided “as is”. To the extent the law allows, we are not liable for indirect or unforeseeable losses, or for decisions you make based on a design. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. We do not exclude liability where the law doesn’t allow it, such as for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.

11. Apple App Store

If you use our iPhone app, you also agree that:

• these terms are between you and us, not Apple, and we alone are responsible for the app and its content;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation;
• Apple is not responsible for handling any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims;
• Apple is not responsible for investigating or defending any claim that the app infringes someone’s intellectual property;
• you are not in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Law and disputes

These terms are governed by the law of [Country whose law governs the terms, e.g. Bulgaria]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring a claim there. Please contact us first. Most problems can be sorted out quickly.

13. Changes to these terms

We may update these terms. We will give you notice of important changes before they apply. If you keep using Moonsill after that, the new terms apply.
